The judicial authority is of special importance, as it is the most important guarantee of respect and protection of the interests of individuals and groups, and as the mechanism entrusted with ensuring the rule of law and the equality of all before its requirements. The judiciary is one of the most important basic pillars for building a state of rights and law, and it undertakes the task of adjudicating disputed rights, in accordance with legal justice that guarantees the conditions of a fair trial in form and substance. The right to a fair trial, the right to resort to the judiciary, the principle of guaranteeing the right to defence, and other legal constitutional guarantees all revolve around independence. The independence of the judge and the judiciary, and the impartiality of justice, are at the center of all these constitutional and legal guarantees, which explains why the principle of independence of the judiciary is It is the focus of modern global attention. Given the importance of the principle of independence of the judiciary in the life of nations, it has become a measure of development indicators in countries of the world, in a way that determines the nature and extent of countries’ progress or backwardness. Therefore, most state constitutions stipulate the principle of independence of the judiciary - as a third authority from the legislative and executive authorities, including the Egyptian and Libyan constitutions. The presence of this third authority alongside them requires its independence from them. This is so that it is not subordinate or subject to either of them, as the state’s powers should not be concentrated in one hand, whether an individual or a body. Because every absolute authority is considered an absolute corruption; Justice cannot be achieved without the independence of the judiciary, which is the most important and supreme requirement for human rights. It is an important guarantee and a basic foundation for establishing the principles of justice and eliminating injustice. In the absence of an independent judiciary in any country, the freedoms and rights of citizens become a structure without a soul. Because any authority in the state can attack these freedoms.
