This study aims to investigate the procedural aspects of international and domestic laws for prosecuting war criminals, and to identify the obstacles and reasons that prevent the application of international humanitarian law in Palestinian territories, which are still under Israeli occupation. It also aims to clarify the role of international humanitarian law in providing protection to civilians and civilian objects during armed conflicts, and to explain the prohibition of acts that constitute violations of these rights. The study further highlights the legal inconsistency of Israeli occupation of Palestinian territories with international treaties and conventions, and its flagrant violation of international humanitarian law, which has created international obligations that have not been adhered to by the Israeli authorities. The study also explores how to resort to courts and procedures for prosecuting those accused of committing serious violations against civilians during armed conflicts before international criminal courts, especially the International Criminal Court, and before national criminal courts with international jurisdiction.
