Criminal responsibility results from doing a specific act or refraining from doing it as criminalized by the law and punished by it in one of the criminal texts. Therefore, the criminal responsibility is realized for the perpetrator of that crime considering that he harmed the entire society. bear the consequences of his criminal actions. The offender may commit his crime while he is fully aware and willing, and then it becomes clear that he was suffering from any mental or psychological disorder, which may affect his bearing the consequences of his criminal actions by canceling or diminishing the two basic pillars of responsibility or encountering in any other stage prior or subsequent to the commission of the crime, while recognizing that the origin It is the recognition of the capacity of the offender at the time of the commission of the crime. The topic of the research occupies a special importance because it deals with the human soul, which God Almighty has honored. Not as a being who committed a crime, but it is necessary to study the psychological link that is based on awareness and freedom of choice (criminal capacity). It is not fair to blame them for their actions. This topic is of great importance in that this condition in terms of its determination in logic and Sharia does not require much effort, but verifying it in reality when it is necessary to know the extent of a person’s responsibility for his actions is very difficult. It highlights its importance in opening a wider field for legal scholars to delve into the field of psychiatry to determine the nature of mental or psychological disorders in which the offender loses awareness or discrimination and freedom of choice to identify them as a barrier to responsibility, as well as to measure them later through the link between medicine and law.
