The information privacy is considered one from the rights which have a tight relation with character. The comparative laws deal with it in different degrees of protection because of its importance and it deserved to be respectable, also for the individual’s dignity and liberty. In the introduction of the research we deal with Putting stuff operation; does the modern legislations mode admit with the individual’s privacy and seek for protecting him?
Through the research and in the warm-up chapter, which include the genesis and the development of the right range in the informational privacy, we realize that this issue is represented in this time as a symbol of development and progress. Also it is problem as old as humanity. People with different ages are different in its content and its goals. So we can’t relate the individual‘s right in his private life to any particular history or culture. The thinkers pay their attention to it from the history dawn and through its ages. The most ancient civilizations and legislations confessed with the idea of the individual’s right in his privacy, also all heavenly religions.
The Islamic legislation is considered the former in his protection. It considered the human rights advertisements the most important of the historical development elements of the human right in his private life as it pay attention to this right and how to protect it. This because of the ongoing technological development which threatens with the informational privacy continuity. The mode laws situation relating to admitting the protection with its kinds of the informational privacy in an independent aspect. Some laws admitted it and made a text of the necessity of protecting it civilly and criminally from any assault but other laws didn’t admit it. They determined the frame of this protection in taking into account the balance of interests between the individual and the interest of society. So the regulator put the restrictions to ensure that budget. We mean in these states which it is possible to assault the privacy information and its sanctity or declaring it without considering that assault. This is represented in the Public interest and the person satisfaction whose privacy is discovered. The matter raised its top by assaulting the privacy and the personal data through modern means (the World Wide Web or the international information network). Although the Coalition efforts of legislation and jurisprudence and the judiciary, its protection is still in vain, insufficient and ineffective because of the danger of the media account which the technological development uses continuously.
The study ends with some conclusions and recommendations; the most important of them are editing and modifying some lawful texts relating materials in the civil law( by responsibility or Compensation) as it is considered an urgent necessity for the text to be clear in the civil law to ban the assault of the privacy information as the French regulator did in the ninth material of the civil law. The need to account for damages that arise because of the individuals’ privacy Violation and not enriching without a reason for the person who assault the privacy besides the necessity of the initiative of the Egyptian regulator to find lawful private rules organize obligations and the states of the responsibility of Internet service providers( the server). Also the legislations should allow committing suits or Requests to cease broadcast of the electronic context that harm the individual privacy. Also there is an urgent need to protect the information which is criminally stored.
