It is subject of the discretion of them an agreement of the most controversial to pics and discussion among scholars, It’s possible, that the administration has something of liberty of action ,and the power of the choosing its behavior in front of this function . In the first case , we are in front of what they called the discretionary power of the administration . where as in the second case, we are in front of the tie-up competence.
But the administration ignore the principal of the legality in front of choosing this acts .So , the discretionary power of the administration have to be exercised in the limit of the legal principal .And that as a legal way to act is governed by good decision by choosing the most suitable with reality and in the public interest without exceeding legality.
Therefore, the enjoyment of administration discretion not intercede for her to be free from judicial control, which has become an urgent demand mainly in the rule of law, and has become recognized that the protection of individual rights and freedoms will not come only through the breadth of judicial control, but include as well as traditional control (control legitimacy) control convenience (modern) censorship, especially censorship management’s estimate is in the process directly discretion.
So the goal of our study of this topic is to reach the extent of judicial control limits that can occur balance between the right of management to retain a degree of discretion to enable them to play their role, and the preservation of individual rights and freedoms.
