This study ”The state and social policies in Iraq after 2003” consists of two main sections, the first section included the theoretical, methodological and conceptual framework and in which, the phenomenon of the state was analyzed as social factor that represented and still represents the backbone of human Sociology, a mechanism for political and social organization and field to competition and conflict and what is produced by this field of implications and solutions to many of the problems inherent in human existence, a review of the nature of emergence of institutions and separation of powers and the emergence of systems of social, economic and cultural rights and relationship of all of that with social policies, their nature and mechanisms and provide a summarization for all of that to be represented in an illustrative framework - Figure 1 – included details on the relationship between the State, the community and social policies, which is a form – a theoretical pilot model for this study. This section also included a critical review of some of the studies, researches and reports related to the subject matter of this study and they included many of the studies which were divided according to theoretical vision to be presented on the basis of their knowledge field and not on the basis of their geographical affiliation as this section included studies dealt with examining the phenomenon of the State, the power and their respective functions and roles, and also studies in social policies and different topics with which the scientific research addressed a lot of issues and problems linked to the theme of social policies. This section also included providing the review of a number of studies that have tackled the issue of development and the relevant issues such as poverty, and other crises. At the end of this chapter, the researcher presented a discussion of research heritage that has been reviewed; consequently, determine the subject matter of this study and its position clarifying its position through asking a compound question represented in the following: (What are the constitutional and legislative frameworks of social, economic and cultural rights in the contemporary Iraq? What is the role played by factors and crises? (tyranny – wars – the absence of development frameworks) and their social results representing in abatement and declination of most of the social functions and roles of the State before 2003? What are the social and political factors and effects (external and internal) that contributed to the re-formation of the State and its new political construction after 2003? How these factors and effects contributed in the production of nature of new political authorities and institutions; thus, What is the nature of social, economic and cultural rights stipulated by the Constitution? What is the identity of the roles and functions of the State in Iraq after 2003? What is the content of their social policies in the light of the constitution and the new political construction? At the last part of this section of the study, the methodological procedures have been identified for this study based on what he taught and learned in the field of scientific research in sociology and these methodological procedures included a set of procedures represented in transferring the compound question of the study into a group of sub-questions that serve to the scientific answer for the study problem. This section also included a determination of the study objective, its scope, style and sources. In the last part of this first section, the conceptual framework of the study was tackled where the researcher chose the concept of the State and some concepts associated with it (such as the quarter State, the fragile State, the State-building) as well as the concept of citizenship and its association with the concept of (social rights) and the other concept chosen by the researcher which is the concept of social policies and its association with the concept of public policies as a concept is mentioned through different meanings near or far from the first concept first. Some of other concepts chosen by the researcher is the concept of the Constitution and its association with the concept of the legislations and their essences, and these concepts collectively have formed an important body of methodological procedures of the study, and they at the same time are tools for analysis, approach and conclusions in all phases of this study.
As for the second part of the study, it included the analytical framework of the study and it consists of four chapters as the first chapter contained the answer to the study sub-questions relating to the constitutional and legislative frameworks concerning the social, economic and cultural rights in the contemporary Iraq. In this chapter, the analysis of constitutional texts, materials and provisions pertaining to these rights since the Constitution of 1925 until the Constitution in 1970 according to the comparative method between these periods, and at the end of this chapter; the researcher presented an analytical vision intensely summarized the nature of rights structure and some legislations associated with them. The second chapter contained an analysis of the political nature of Iraq and the totalitarian State that produced by this construction, reviewing and analyzing the most prominent stations and policies that led to the lack of production of national identity and that produced these policies and as a result of the crises and the social effects there has been a collapse of most of the systems of the State and its impact on the whole social structure of the community or caused revival and rising of the sub-identities social active and influential classes in the various dynamics and interactions of community, all this on the future affected the State future as a phenomenon and comprehensive structure for social construction and at the end of the chapter, the researcher drafted the most important results of this review, description and analysis while the third chapter of this study is the analysis and description of the social, economic and cultural rights in the applicable Constitution of 2005, and it dealt with the nature of a democratic political system and conflict of sub-identities as well as the description and analysis of the new constitutional process after 2003, and the implications of social rights and at the end of chapter, the researcher presented some results contained in the description, the review and analysis of the nature of the political system and the conflict of sub-identities. The fourth chapter of this study contained description, review and analysis of building the political institutions in the Constitution of 2005, and the arguments of democracy through electoral processes (elections in 2005 – the trends and elections of 2010), the sectarian and ethnic trends which produced by them and according to them, it was built what is known as consensual democracy between races and groups, which later led to the so-called sectarian ethnic allocations of the State institutions and the production of a state based on the categories of sub-identities that formed from them including the political institutions the House of Representatives and the Central Government, and what resulted from them resulting and the process of making and implementing policies, and what has been produced by all these political dynamics and interactions representing in the emergence of new variables such as the terrorism, the armed militias and the organized violence and a wide array of financial corruption, and at the end of chapter, the researcher showed its most important results. The study in the light of its analytical chapters and what has been used in it of the descriptive methods, comparing and analyzing the sources, documents and events in the light of the methodologies of sociology on a set of findings and recommendations. The study also included a list of sources and references including books, studies and researches in both Arabic and English languages including the Internet sites.
