المستخلص تعالج الرسالة موضوع: " أثر المرض النفسي في أحكام القضاء والدعاوى والشهادات- دراسة فقهية مقارنة" تقع الرسالة في مقدمة وتمهيد وثلاثة فصول وخاتمة، وقد جاءت على النحو التالي: المقدمة: حدد الباحث فيها طبيعة الموضوع، وأهميته، وأسباب اختياره، والدراسات السابقة، ومنهجه في الرسالة، وخطة البحث 0 وتناول التمهيد بيان مصطلحات الدراسة. الفصل الأول: أثر المرض النفسي في أحكام القضاء، وجاء في ثلاثة مباحث. الفصل الثاني: أثر المرض النفسي في أحكام الدعاوى، وجاء في مبحثين. الفصل الثالث: أثر المرض النفسي في الشهادات، وجاء في ثلاثة مباحث. وتضمنت الخاتمة عرضًا إجماليًا لما تم الوصول إليه من نتائج. وتم تذييل البحث بمجموعة طيبة من الفهارس الفنية، إضافة إلى فهرسة نوعية لمراجعه، وأخيرًا فهرس الموضوعات. It aims also at identifying the Islamic Jurisprudential Rulings regarding the court judgments, lawsuits and testimonies related to those who suffer from Neurotic or Psychotic disorders, to reach the Islamic Sharia’s goals and objectives regarding those affected by such disorders to show mercy to them, protect them and deliver justice. This paper is based on the incomplete inductive reasoning that relies on tracking partial matters to deduce general provisions control the way courts deal with persons who suffer from Psychological Disorders. Moreover, this paper relies on the descriptive approach concerned with visualizing jurisprudential issues from their approved sources. Its purpose is to conclude and analyze the Psychological Disorders related provisions, to reach the aspired thesis outcomes. Pursuant to the said comparative approach, the paper highlights the differences among the 4 Islamic jurisdiction schools regarding the impact of such Psychological Disorders. The thesis proposal is outlined in three chapters preceded by an introduction and a preamble, and concluded with the important sources and references. The thesis introduction included a description of the thesis topic, identifying the reasons for choosing it, the difficulties that the researcher faced and how to overcome them and the thesis methodology and mechanism. The preamble mentions the nature of Psychological Disorders in terms of linguistics, jurisprudence and according to psychologists, as well as the difference between Psychological Disorders and mental illness. Chapter 1 shows the impact of Psychological Disorders on court judgments, explaining their impact on the judge and judicial rulings. Chapter 2 explains the impact of Psychological Disorders on proceedings, while showing its impact on the lawsuit, and both the defendant and the plaintiff. Chapter 3 examines the impact of Psychological Disorders on testimonial provisions, while showing its impact on testimony and acknowledgment and its relationship to psychological tests and their impact on pressing charges. This thesis concludes with a set of results which is mentioned in the conclusion.
