Abstract

There is a growing demand for arbitration as a way of resolving disputes in engineering cases. This research’s main advantage is to contrast British and Egyptian arbitration proceedings in construction to suggest any potential changes to the Egyptian arbitration procedures, especially the Egyptian Arbitration Law (EAL). If disputes are resolved without wasting much time, this will encourage the various parties in construction, including contracting companies, consulting offices and others, to invest in Egypt and make the investment environment attractive. Three steps will accomplish the research methodology. Firstly, by comprehending the Arbitration Act 1996 and ICE proceedings, the Institution of Civil Engineers. Secondly, by giving an insight into areas of strength and weakness in the Egyptian arbitration procedures to overcome the shortcomings by the entire evaluation of the British arbitration mechanism. Finally, by holding face-to-face interviews to develop dispute settlement procedures with experts and arbitrators in Egypt. The research also touched upon making a comparison between the Egyptian and British mediation procedures and clarifying the obstacles that hinder the spread of mediation in Egypt, in addition to making a comparison between mediation and arbitration.
