The expiry of the penalty decided by the judiciary naturally exhausts its content by its implementation of the criminal responsibility for a crime that could be attributed to him, and then this penalty expires by completing the implementation of its legal conditions, as the natural way to expiration of the penalty is its implementation, that is the normal way to achieve its purposes so that it does not remain for it Then replaced. But the matter does not always go this way, but often reasons occur before or during execution that lead to the fall of the penalty, and among these reasons, the most important and most controversial is the special amnesty, this exceptional system is of great interest in Sharia and legal and is the basis of the subject of our research. The system of special amnesty is always something related to punishment, in contrast to a comprehensive amnesty that relates to the crime itself, and therefore it does not erase the character of the crime from the committed act, but rather prevents the implementation of the punishment or leads to its mitigation, and this amnesty is usually decided by the different legal systems of the head of state, which Accordingly, the latter can, by a decision from him, remove the convict from an enforceable penalty from all or some of this penalty, or replace it with a lesser penalty. This amnesty has played an important role under the old regimes, and occupies a prominent place in the interest of contemporary criminal policy. Modern legislation is not devoid of this humanitarian system, which has become one of the basic principles in the various legal systems.
