This study deals with the authority of the governor in organizing the judiciary. The Islamic Sharia gave the governor the right to regulate the affairs of the citizens, including the judiciary, and this authority is evident whether in the decisions or laws issued by the governor in order to improve the judiciary facility, organize the judicial affairs , appoint and dismiss judges, distribute therefore the essentiality of this matter is clearly manifested, which is the authority of the governor in organizing the judiciary. The researcher has followed in this study both the descriptive analytical approach and, the comparative approach. This study included jurisdictional competences, working to expedite the implementation of judicial decisions, and setting up procedures for litigation into conformity with modern judicial systems, an introductory section and three chapters provided with a conclusion, where the researcher clarified in the introductory section the definition of the key-vocabulary of the research which is the authority - organization - the governor - the judiciary, and then in the first section dealt with the governor’s terms of reference concerning judiciary (of a legislative, administrative and judicial nature) also discussed in the second chapter the authority of the governor in organizing the judiciary, whereas in the third and final chapter the researcher reviewed guarantees of independence of the judiciary in the Islamic state. In the conclusion, the researcher concluded a set of results, the most important of which were: - The authority of the governor in Islamic law is a broad authority, so he may establish from the systems and judicial bodies what he sees as fulfilling for the purposes of the law and the interests of the nation. The jurisdiction of the head of state is also varied and diversified in Islamic law, including legislative, executive and judicial. The researcher also reached a set of recommendations, the most important of which were: amending the Judicial Authority law, especially the law on organizing the Judiciary in a manner that guarantees activating the use of modern systems that contribute to the development of the judiciary besides benefitting from the experiences of developed countries in this field.
