In the name of Allah, the most gracious, the most merciful
This is a study for Bids and tenders, doctrinal study compared
Such this study is a wide ranging and indeed complicated.
The nature of the study should be put in preface, overture, two large sections and finale.
● The first section is entitled «Contract of Bid doctrinal study compared», It contains six chapters:
- The first chapter is entitled «fact of Contract of Bid».
- The second chapter is entitled «Contract of Bid : its rule, its staff, and its types».
- The third chapter is entitled «Conditions at Contract of Bid».
- The fourth chapter is entitled «Broker at Contract of Bid».
- The fifth chapter is entitled «acts of forbidden which are obscuring with Contract of Bid».
- The sixth chapter is entitled «Issues at Contract of Bid and a statement of its provisions».
● The second section is entitled «Contract of Tender doctrinal study compared», it contains three chapters:
- The first chapter is entitled «fact of Contract of Tender».
- The second chapter is entitled «Contract of Tender: its reign, and its staff, and its types».
- The third chapter is entitled «Issues at Contract of Tender and a statement of its provisions».
- The epilogue, it contains General results and The most important recommendations.
Causes of choice study:
Causes of choice study condense in the following points:
1- Replying on questions and inquiries about subject of Bids and Tenders and it contemporary cases; to show an ability of Islamic Shari’a on the treatment with a new events in this subject.
2- Rank of this subject from the contemporary interests.
3- Personality desire in showing the Islamic position from this subject.
4- Modest endeavor to supply the shortage of speech on one sides of contemporary economic policy, which seldom has studied from point of view of Islamic Shari’a.
5- Publication of a book explains Essence Bids and Tenders, and appoints Muslims to know their provisions; to stand on the college rules and issues detailed regulations which adjust behavior of the Muslim and his actions in this vital subject is important; as its article the scientific is sporadic Between pages of the many books.
6- I don’t know who wrote in this subject separately, which combining their dispersion and show its provisions, especially at the masters and doctorate.
Research Methodology:
I didn’t limit myself to a single approach to research methods because of the nature of research. but I relied on a number of approaches, namely: inductive, Naqli, deductive, analytical, synthetic, and critical.
Study Aims:
Objectives of this study lies in clarify the Shari provisions and restrictions related to the subject of Bids and tenders.
Importance of study:
Importance of study seem in commandments following:
1- Study’s correlation at reality.
2- Lack of writing at this subject of contemporary.
And finally, I have traced some contemporary studies that comprised some parts of the study; to produce inclusive study at bids and tender.
Thus, I have given guiding scientific answers to everything that pertain rules of Bids and Tenders.
I hope that this thesis has given useful answers on subject of Bids and Tenders and its rules in the Islamic Fiqh.
I also hope it will be useful model at our contemporary life.
Above all, I hope Allah’s grace, He is our Guide to the straight Path, I thank Allah, the Lord of the Worlds
