المستخلص Aim of Thesis: The aim of the thesis is to define Sheikh Ganguhy and highlight his efforts in jurisprudence and principles. Stage of Thesis: master’s Thesis in Islamic Jurisprudence. Planning of Thesis: The thesis’ schema is divided into preface, four chapters and conclusion. Preface: I have noted in the preface the importance of the subject, the reasons for choosing this subject, curriculum research, plan research, and difficulties in research. First Chapter: I have made the definition of the ”era of Sheikh Ganguhy politically, religiously, scientifically, and culturally. I have talked on the conditions of the Indian subcontinent by the political, economic, and cultural, where English occupation managed to extend its influence on India, the dissemination of sedition and corruption among Muslims and Hindu people, as I have also talked on the resistance and protest of the scholars and kings to expel the English from India, and the role of Ganguhy in it. Second Chapter: I have made definition of Sheikh Ganguhy as his name, nickname, parentage, birthday, growth, qualities, and virtues, jihad, affliction, imprison, and his quest for science and travels, his teachers and his students, with a statement of his scientific position, and his scientific written and effects, and his death. Third Chapter: The contribution of Rashid Ahmad-Al Ghanguhy to the Islamic Jurisprudence and its Principles. It includes introductory chapter about three headings, as for the introductory chapter: It deals with the importance of the Islamic Jurisprudence and its principles as stated by Sheikh Al-Ghanguhy. First Heading: Al-Ghanguhy contributions to the legislative sources. The researcher spoke about position of Al-Ghanguhy < << << < Summary of the Thesis ٣٨٢ concerning taking Qur’an, Sunnah, the consensus agreement, analogy as well as the position of the Companions (pbut). The traditional Customs Al-Isthsan as proofs. In addition to mentioning practically issues. Second Heading: The researcher gave examples of the Usuli Selections of Ghanguhy with a comparative studies in some issues as if the trustworthy narrator adds something, is it accepted or not? Is the general proof decisive evidence or speculative one? Is The Imperative figure indicate obligation or otherwise? Third Heading: Al-Ghanguhy position of taking the Fighi maxims as proof in which the researcher takes meaning of the Fighi maxims, linguistically and technically the difference between the legal maxims and the Usuli maxims in which he mentioned some practically examples quoted from the previously quotes from Al-Ghanughy. Fourth Chapter: The Efforts of Sheikh Rashid Ahmed Ganguhy in jurisprudence. It includes Three Headings. In the First Heading: I have stated the definition of the Hanafi school as language terminology with showing statement of historical roots of Hanafi school, and how spread this doctrine in the Indian subcontinent. And the Second Heading: in which I have talked about the doctrine of Sheikh Ganguhy and his position in it and his preference and commitment with it, but that was mild where unlikely of The Hanafi school without evidence, and I have explained it with mentioning some of his jurisprudence and fundamental choices. And the Third Heading: I have specified by mentioning some models of Ganguhy’s jurisprudential choices from various doors of jurisprudence, as worship, transactions, and the provisions of the family, hudud and penalties, including: not hatred of prayer before the establishment of Maghrib prayer, receiving money on teaching of the Qur’an and necessity of religious sciences and to judge on who marries his father’s wife- step mother. And The Conclusion: I have written in it of the most important scientific results reached by the search in this topic, such as: the Sheikh Ganguny was one of the scientists, scholars and investigators, and has contributed to spread of the Hanafi School in the Indian subcontinent, known for his time as sincere and chastity construct, chivalry, and firmness in religion. And Holy Qur’an is the first source of legitimacy to the Ganguhy, but this is the source of sources, because the other sources, that I knew their < << << < Summary of the Thesis ٣٨٣ authenticity from the Qur’an that shows it, and the rules fundamentalism jurisprudential and fundamental rules have superpower to Ganguhy as he supplies by judging and giving evidence with them much more, we’ll find out them scattered in his books. My Advice: • To establish special center to collect Indian scholars books with reformulating them so that the nation can get benefit from them. • To call for implementing the books written by Ganguhy and print them so the books will come out in a good shape in which will be much more benefits for the students.
