Abstract
There is no doubt that the Egyptian economy is going through a very difficult circumstances as a result of the political situation of the country, and due to the strategic importance of national projects which held by BOT system it is important to study and analyze previous contracts and agreements to determine negative aspects and to avoid that the government to repeat these mistakes during the implementation of
new projects of this system.
The research aims to identify the negatives in the previous BOT agreements in Egypt and tills through the analysis of the project contracts of these previous projects and analyzing the problems that occurred during these projects and comparing it with what is happening in other countries such as China. It was so clear to find many different malpractices in the application of such type projects in Egypt compared to other countries. Also a comparison between the clauses of the BOT contracts and what came in the FIDIC silver book. The research stated many recommendations to overcome mistakes happened m previous projects and hopping to avoid them in the future agreements.
