The study handled the subject of the obligations and the rights of contractors in implementation of BOT contracts, by clarifying the concept of these contracts and their characteristics and forms, and the determination of constitutional and legislative framework and dealing with the legal adaptation of these contracts, and distinguishing between the BOT contracts and the other contracts.
The study has handled the obligations of the project company in implementation of BOT contracts, that is, the obligation of the personal implementation contract, and constructing and operating the facility transferring the facility to the administrative authority after the termination of the concession period. The study also dealt with the obligations of the administrative authority in the implementation of the BOT contracts which are the obligation of assisting the project company in obtaining the necessary licenses for constructing and operating the facility, over – handling the work site to the project company, and protecting the project company from competition.
The study reviewed the right’s of the project company resulted from the contract, these are, financial rights represented in its, right of collecting fees from users of the facility services, sub concession rights, and its right in getting the compensation which guarantees the achievement of financial balance of the contract. Also, it reviewed the rights which are enjoyed by the administrative authority in BOT contracts, these are, controlling and supervising right of contract implementation right of modification, the right of executing administrative sanction, finally the right of restoring the facility.
